The State of California has listed substances that are known Carcinogens and Reproductive Toxicants in many consumer products.


What is California Proposition 65?


Proposition 65 , known as the Safe Drinking Water and Toxic Enforcement Act, was enacted in California in 1986 to address growing concerns about exposures to toxic chemicals.

California aims at restricting contamination by toxic chemicals in articles by informing consumers if certain hazardous substances are present in a product or its packaging. It is also supposed to give businesses a sense of responsibility.

Proposition 65 Requirements


Proposition 65 requires the Governor’s office to publish a list of chemicals known by the State of California to cause cancer, birth defects or reproductive toxicity. The list is updated at least once a year and concerns over 800 chemicals.

Scope


California Prop 65 affects all products sold or distributed in California, including:

  • Toys
  • Clothing
  • Cosmetics
  • Jewellery
  • Electrical devices, Wires & Cables  
  • Premium and decorative items
  • Dyes
  • Articles used in manufacturing and construction
  • Food
  • Drugs  
  • Agricultural pesticides
  • Glass & ceramic materials
  • By-products of chemical processes: exhaust from motor vehicles, tobacco smoke, burning natural gas
  • Etc.

Main chemicals regulated under Proposition 65 are lead, heavy metals, solvents, phthalates, VOC, etc.

Requirement

Firms doing business in California and exposing individuals to chemicals “known to the State” to cause cancer, birth defects or reproductive toxicity must:

  • Provide clear and reasonable warning
  • Do not discharge listed chemicals into drinking water

Key elements:

  • A warning must be given for listed chemicals unless exposure is low enough to pose no significant risk.

  • Warning labelling is required if the product does not meet the requirements of Proposition 65.

  • The warning message must clearly communicate that the chemical in question is known to the State (California) to cause adverse effects.
